Greenfield man gets community control in failure to comply case

A Greenfield man was sentenced to community control recently after pleading guilty to failure to comply with the order or signal of a police officer, a third-degree felony.

Bailey M. Simmons, 24, was indicted on that charge during the Tuesday, March 5 Highland County grand jury session.

The indictment alleged that on or about Feb. 20, Simmons “did operate a motor vehicle … so as willfully to elude or flee a police officer after receiving a visible or audible signal from a police officer to bring [his] motor vehicle to a stop, and the operation of the motor vehicle by [Simmons] caused a substantial risk of serious physical harm to persons or property.”

According to a bill of particulars, a Greenfield police officer attempted to initiate a traffic stop on Simmons’ vehicle, which allegedly did not have a license plate. It is alleged that Simmons “would not stop and drove through multiple stop signs throughout Greenfield, including speeding through a construction area and swerving around workers in vests.”

The bill of particulars alleges that the “pursuit lasted 2.07 miles in which Simmons ran five separate stop signs and passed through a construction zone where city workers were actively working on a sewer line.”

Simmons pleaded guilty to the charge May 1, and on June 5, he was sentenced by Highland County Common Pleas Court Judge Rocky Coss to three years of community control.

In addition, Simmons was ordered to successfully complete the STAR program and any recommended aftercare. His driver’s license will be suspended for three years, effective June 5.
