Gipson found competent to stand trial on murder charge WATCH THE VIDEO

A Greenfield man has been found competent to stand trial on a murder charge in Highland County Common Pleas Court.
Presiding Judge Rocky Coss had ordered the evaluation for Kermit Gipson, 22, who is accused in the Jan. 20 shooting death of Judy Mosler.
The evaluation was conducted by Forensic Mental Health Services Inc., Coss said during an evaluation hearing on June 4.
Gipson appeared in the custody of the Highland County Sheriff's Office, and was accompanied by his attorney Michael Kelly.
The state was represented by Highland County Prosecutor Jim Grandey.
Coss said the report found Gipson was able assist in his own defense.
Grandey told the court that the discovery process for the case had been completed as far as he was aware. Kelly said he had issues with discovering elements regarding alleged statements that "were made to third parties by the decedent."
Grandey said the only conversation he planned to use at trial was a conversation in which the decedent (Mosler) was on the phone with her sister and the sister allegedly overheard Gipson making comments to the decedent.
A family member of the defendant who was observing the court proceedings interjected, raised her hand and said, "No, I need to speak."
Coss said, "Ma'am there is nothing for you to say right now."
Kelly motioned for her to sit down and said, "Be quiet."
"If you have something you want to talk with the attorneys about you may do so," Coss said. "But do not interrupt the proceedings again."
Coss said hearsay issues regarding the conversations between Gipson and Mosley would be addressed the morning of the first day of trial.
Both attorneys then asked for a final pretrial hearing to be scheduled for Monday, June 7 at 1:30 p.m.
Gipson is scheduled to stand trial in Highland County Common Pleas Court on the murder charge, an unclassified felony, and a charge of tampering with evidence.
As previously reported in the Highland County Press, according to Greenfield Police Chief Tim Hester, the department received a call at 1:56 p.m. Jan. 20 of a reported shooting at 631 South Street. Upon arrival, officers found a female victim, Judy Mosler, 24, of that residence, had sustained a single gunshot wound to the abdomen. Paint Creek EMS transported Mosler to Adena-Greenfield Area Medical Center. Mosler was later transferred to Miami Valley Hospital with critical injuries. Mosler later died at Miami Valley. Officers recovered a handgun believed to be used in the shooting, Hester said.
