Deters faces 61-day suspension

Northern Kentucky attorney Eric Deters faces a 61-day suspension from the practice of law, after a decision by the Kentucky Bar Association Board of Governors.

Deters originally faced a suspension of 181 days by the board.

Deters said he plans to appeal to the Kentucky Supreme Court.

In addition to practicing law, Deters is involved with a number of business ventures and hosts a talk radio show in Cincinnati. He has been a columnist for The Highland County Press since October 2010 and was a recent guest speaker for the Highland County TEA Party at the Colony Theater in Hillsboro.

Until the Supreme Court rules on the case, Deters may continue to practice law.

Trial Commissioner Frank P. Doheny, a partner in Dinsmore and Shohl law firm in Louisville, had recommended the 181-day suspension, stating Deters “engaged in a pattern of conduct that simply stated is ‘sue first, ask questions later.’"

In a Sept. 17 statement to The Highland County Press, that is posted in his online newsletter, Deters said: "A biased trial commissioner had recommended a 181-day suspension. I was charged with 19 violations of the lawyer ethical code on six cases. They found me guilty of only four of 19 violations. Rather than 181 days, they recommended the much smaller time of 61. I will appeal these four to the Kentucky Supreme Court. I'm confident of complete exoneration. We have countless winning issues.
 
"I violated no ethical rules. The board found me guilty of the following: improper termination of a client (no idea why); saying something false about a judge (the judge admitted everything I said was true at my hearing); improper contact with a prospective client (this man lied and I proved it) and lack of candor to a tribunal (I'll have to read the order when they send it.)
