Appeals court upholds conviction of area doctor

The Twelfth District Court of Appeals has affirmed the conviction of a Clinton County physician on one count of public indecency, one count of attempted rape, and two counts of gross sexual imposition.

According to a press release issued Monday by the court, "On July 26, 2007, a 52-year-old married mother of two filed a police report with the Wilmington Police Department alleging that Daniel M. Moshos, a physician with Corporate Health Services located in Wilmington, Ohio, exposed himself and asked her to perform oral sex during a follow-up examination conducted at his office. On Aug. 27, 2007, following further police investigation, Moshos was arrested and charged with public indecency. 

"On Sept. 5, 2007, Detective Josh Riley of the Wilmington Police Department

received a call from an anonymous woman claiming Moshos forced himself upon her on a number of occasions. Upon further police investigation of these new claims, which included identifying the anonymous woman as 44-year-old single mother, Moshos was indicted on two counts of gross sexual imposition and one count of attempted rape. Following a four-day jury trial, Moshos was found guilty on all charges and sentenced to serve a total of three years in prison.

"Moshos appealed to the Twelfth District and argued that the trial court improperly admitted evidence at trial and that the evidence did not support his conviction. Writing for a unanimous court, Judge Robert A. Hendrickson found that the trial court did not improperly admit evidence at trial, and that Moshos' conviction was supported by extensive evidence detailing the victims' unwanted sexual encounters. Presiding Judge Stephen W. Powell and Judge Robert P. Ringland concurred in the opinion. The decision of the Twelfth District Court of Appeals affirmed Moshos' conviction for one count of public indecency, one count of attempted rape, and two counts of gross sexual imposition."
